Terms & Conditions

These Terms & Conditions of Use ("Terms") govern your access to and use of the Project42 website, mobile apps and online services (together, the “Service”) operated by Project42 (“we”, “us”, “our”). By accessing or ordering from the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use or purchase from the Service. By placing an order you represent and warrant that you meet these eligibility requirements.

2. Products, descriptions & availability

We attempt to display product information (sizes, colours, images, prices) accurately, but we do not guarantee complete accuracy. Product availability may change without notice. We reserve the right to limit quantities, refuse or cancel orders (including orders that appear fraudulent or erroneous).

3. Ordering & acceptance

Placing an order is an offer to purchase. We may accept orders by sending an order confirmation email. An order is only binding when we send a shipping confirmation or accept the order in writing. Prices and promotions are subject to change until we accept your order.

4. Payment & Stripe

We accept payment through the methods shown at checkout. Card and electronic payments are processed by third-party payment processors (for example, Stripe). Card data is submitted directly to the payment processor and is not stored on our servers except as permitted by that processor (e.g., last four digits, transaction metadata). By using a payment method you agree to the payment processor’s terms and privacy policy. You authorize us to charge your selected payment method for the total order amount (including taxes, duties, shipping and any applicable fees).

5. Shipping & fulfilment

All order fulfilment, shipping and delivery are outsourced to a third-party fulfilment agency and to suppliers. Shipping methods, carriers, delivery windows, tracking and some returns rules are set by that agency/suppliers — not by Project42. Review the fulfilment agency’s shipping & returns policies before purchase. Project42 will assist with claims and coordination, but final outcomes may depend on the supplier’s policies.

6. Returns, refunds & exchanges

Returns, exchanges and refunds are governed by the Returns Policy posted on our website and, where applicable, the supplier/fulfilment agency’s policies. For faulty, missing or incorrect items contact project42.2025@gmail.com with your order number and photos promptly. Refunds will be issued by the original payment method subject to our and the supplier’s procedures.

7. Prices, taxes, duties & customs

Prices shown do not always include taxes, duties or import fees. For international orders, customs duties, taxes and clearance fees are the customer’s responsibility unless stated otherwise. We are not responsible for delays or additional charges imposed by customs authorities.

8. Intellectual property

All content on the Service (text, images, logos, designs, software) is owned or licensed by Project42 and protected by intellectual property laws. You may not copy, reproduce, republish, upload, post, transmit or distribute any material from the Service without our prior written permission except as necessary to use the Service (e.g., placing an order).

9. User content & reviews

If you post reviews, ratings, photos or other content (“User Content”), you grant Project42 a worldwide, royalty-free, perpetual, sublicensable license to use, reproduce, adapt and display that content in connection with the Service. Do not submit content that is illegal, infringing, obscene or offensive. We may remove User Content at our discretion.

10. Prohibited conduct

You agree not to:
Use the Service for illegal or fraudulent purposes;

Interfere with or harm the Service or its users;

Circumvent security, scrape content, or perform automated access to the Service without permission.

11. Disclaimers

THE SERVICE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROJECT42 DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PROJECT42, ITS EMPLOYEES, CONTRACTORS OR SUPPLIERS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF BUSINESS, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM (OR S$100, WHICHEVER IS GREATER), EXCEPT WHERE LAW REQUIRES OTHERWISE.

13. Indemnification

You agree to indemnify, defend and hold Project42 and its affiliates harmless from any claim, loss, liability or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of third-party rights.

14. Product disclaimers & limitations

Sizes, colours, materials and performance of garments may vary. Sportswear is provided for general recreational use only; any performance claims are as described by the manufacturer. Ensure appropriate use and care of products.

15. Privacy

Our Privacy Policy explains how we collect and use personal data. By using the Service you consent to our collection and processing as described in that policy. (Link to Privacy Policy on your website.)

16. Third-party services & links

The Service may contain links to third-party sites and use third-party services (fulfilment agencies, payment processors, analytics). We are not responsible for third-party practices or content. Your use of third-party services is subject to their terms.

17. Suspension, termination & changes to the Service

We may suspend or terminate access to the Service, cancel orders, or refuse service for any reason (including suspected fraud or violation of these Terms). We may modify or discontinue features at any time. We will try to notify you of material changes, and will post updated Terms on the Site.

18. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will reflect changes. Continued use of the Service after changes constitutes acceptance of the revised Terms.

19. Governing law & dispute resolution

These Terms are governed by the laws of the Republic of Singapore. Except where prohibited by mandatory law, you and Project42 agree that disputes will be submitted to the courts of Singapore or resolved through any dispute resolution mechanism we both agree to.

20. Severability

If any provision of these Terms is held invalid or unenforceable, the remainder of the Terms will continue in full force and effect.
